OMEGAXL HOLIDAY WELLNESS GIVEAWAY OFFICIAL RULES
1. NO PURCHASE NECESSARY TO ENTER OR WIN.
2. HOW TO ENTER: Beginning on December 18, 2025 at 12:00 AM EST through December 24, 2025 at 11:59 PM EST, you (“Entrant”) must follow the following steps:
- a. Follow @OmegaXL on Instagram;
- b. Like the corresponding giveaway post; and
- c. Tag 2 friends in the comments on the corresponding giveaway post.
No more than one (1) entry per day per person is permitted. Use of any robotic, automatic, programmed, or similar entry method or entering more than the number of times permitted will void all entries and result in disqualification. You may not enter more than once by using multiple email addresses, accounts, identities, or devices in an attempt to circumvent these Official Rules. Any changes to the giveaway will be notified to Entrants as soon as possible by the sponsor identified below (“Sponsor”). Sponsor reserves the right to cancel or amend the giveaway and these Official Rules without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of Sponsor’s control. Sponsor is not responsible for suspended or discontinued Internet or wireless service, or a change in an Entrant’s email or mailing address which may result in a Potential Winner not receiving initial prize notification or his/her prize information.
3. ELIGIBILITY: Open to residents of the 50 United States and D.C. 18 years of age and older. Employees of Great HealthWorks, Inc. or its affiliated companies/agencies/organizations and their respective parents, subsidiaries, as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible to participate. Void where prohibited.
4. DRAWING: One (1) potential winner (the “Potential Winner”) will be chosen at random from all eligible entries received. Odds of winning are dependent on the number of Entries received. Sponsor will announce Potential Winner via Instagram Story and will reach out to the corresponding Potential Winner via Instagram Direct Message (“DM”) on December 23, 2025. The Potential Winner has forty-eight (48) hours to respond via DM with full name and the address that the prize should be shipped to. Failure to send the email response within the aforementioned 48-hour timeframe shall result in forfeiture of the prize and Sponsor may, at its sole discretion, select another Potential Winner. The Potential Winner is responsible for providing an accurate shipping address, as Sponsor is not responsible for lost shipments. By participating in this giveaway, Entrants accept and agree to these Official Rules and the decisions of Sponsor, which shall be final in all matters. Acceptance of a prize also constitutes Potential Winner’s consent to the use of Potential Winner’s name, image, and likeness, including biographical information, in perpetuity in any marketing material without further compensation or right of approval where permitted by law. If Entrant submitted their entry through a social media network, then Entrant forever releases and discharges the company operating that social media network from any and all liability relating to this giveaway. This giveaway is in no way sponsored, endorsed, or administered by, or associated with Instagram, Owala, FitBit or any other third party.
5. BACKGROUND CHECK: If Sponsor so elects, a Potential Winner may be required to submit to a confidential background check. Such background check may include (but is not limited to) investigation of criminal, sexual offenses, or other arrest or conviction record, and any other factor deemed relevant by the Sponsor to help ensure that the Potential Winner will not bring the Sponsor into public disrepute, contempt, scandal, or ridicule or reflect unfavorably on Sponsor. If requested, the Potential Winner agrees to sign waiver forms authorizing the release of personal and background information. In the event of noncompliance, to be determined at the sole discretion of Sponsor, prize will be forfeited, and an alternate Potential Winner will be randomly selected. Subject to verification of eligibility and compliance with the terms of these Official Rules, including verification that the Potential Winner is eighteen (18) years of age or older, the Potential Winner will be declared an official winner (the “Winner”) of the giveaway.
6. PRIZES: All prizes are as stated, and no cash or other substitutions will be offered. Limit one (1) prize per family or household. Prizes are not transferable. Prizes are subject to availability, and Sponsor reserves the right to substitute any prize with another of equivalent or greater value without giving notice. If applicable, Winner is solely responsible for all taxes associated with prize acceptance and receipt.
7. RELEASE: By accepting a prize, Winner agrees to release and hold Great HealthWorks, Inc. and its affiliated entities, officers, and employees (collectively, the “Released Parties”), harmless from all losses, damages, rights, claims and actions of any kind resulting from acceptance, possession or use of any prize including, without limitation, personal injuries, death and property damage. IN NO EVENT WILL THE RELEASED PARTIES AND/OR THEIR PARENTS, AFFILIATES, SUBSIDIARIES AND RELATED COMPANIES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR PARTICIPATION IN THIS GIVEAWAY. IN NO EVENT SHALL THE RELEASED PARTIES’ TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE RETAIL VALUE OF THE GIVEAWAY PRIZE. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE WEBSITE INCLUDING THE PRIZES IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.
8. DISPUTE RESOLUTION AND WAIVER OF TRIAL BY JURY. IT IS MUTUALLY AGREED BY AND BETWEEN ENTRANT AND SPONSOR THAT ANY CLAIM THAT ENTRANT MAY HAVE IN THE FUTURE MUST BE RESOLVED IN ACCORDANCE WITH SPONSOR’S TERMS AND CONDITIONS.
9. CHOICE OF LAW AND FORUM: Entrant agrees that all matters arising out of or relating to this giveaway and these Official Rules are governed by, and construed in accordance with, the laws of the State of Florida, without giving effect to any of its conflict of laws provisions thereof. Entrant further agrees that any legal suit, action, or proceeding arising out of or relating to this giveaway and these Official Rules that is excluded from the dispute resolution procedure and class action waiver provisions set forth in these Official Rules shall be brought exclusively in the courts located in Broward County, Florida.
